Jake Sully, a handicapped ex-Marine, has to operate an avatar and act as a bodyguard because his twin brother who was trained to operate an avatar was killed. Soon after, Jake was told to persuade the Native inhabitants of Pandora, the Navi, to move out of the way so that the corporation could mine the huge unobtainium deposit located under their home. After many experience living as a Navi, Jake managed to become one of their people. The corporation moved in to destroy the Navis home because Jake took too long. Once the Navis home was destroyed, Jake realized how evil the corporation was and rebels against the corporation. In the end, the Navi and Jake manage to gain victory over the Marines and the evil corporation. Many have criticized this film as racist because of the male protagonist being a white man. I dont think Avatar is a racist film at all. Personally I didnt feel offended that there were no Asians or African Americans in the film. If the Jake was played by a black man like Will Smith or Denzel Washington, then the ending would be spoiled because we watched enough Will Smith movies to know that he will save the Navi and end up being the hero. Using a not-so-well-known actor would question how the film would end. Also, Jake is not the only one who decides to change sides. The operations leader, Selfridge, also learns that what hes doing is wrong. The Vatican commentators gave Avatar negative comments, saying that the film gets dragged down by a spiritualism linked to the worship of nature. In this case, the Navi worship a goddess named Eewa. They are very religious beings that live in a gigantic tree. (LOsservatore Romano). I dont think the film was in any way offensive towards religion. The Navi were representatives of the Natives in our time, who were also very in touch with nature. The conservatives in the US claim that the movie is anti-American and anti-capitalist in its portrayal of humans as greedy creatures. I disagree with the conservatives. Greed is one of the true natures of humans. We are naturally greedy and want more then what we have already. James Cameron wasnt trying to offend the citizens of the United States but just trying show the nature of humans. The doctor in the film, Grace, was shown to be smoking throughout the entire movie. Smoke Free Movies, a campaign, took offence to this act. James Cameron states that he was making the character look evil. I agree with James Cameron when he responded to this comment by saying that we need to get used to modern times. If smoking is bad and shouldnt be shown in movies, then wouldnt that mean stealing and murder shouldnt be shown as well because its bad. The Marine Corps accused Avatar of stereotyping members of the Marines. I think that Avatar does stereotype members of the Marines. All the Marines in the movie kill the creatures and Navi without hesitation. When the Hometree was being bombarded, none of the ships backed out or even thought about disobeying except the girl. This shows how ruthless and greedy these men are. I would have made it so that more than just the girl back off from the attack just to show how sympathetic they are. All those people who wish Pandora is real are total losers. Its a science-fiction movie for goodness sakes. How can you criticize a movie by saying the alien planet doesnt exist. Some person even said he wanted to live like a Navi. I definitely disagree with their criticism towards Avatar. I cant believe people would actually become depressed because Pandora doesnt exist. Thats just plain stupid. All those people who wish Pandora need to go experience the world more. Besides, even if Pandora was real, Im sure theyd end up going there and getting killed.

But in the reality, the employee doesnt have much privacy. This document will display information on employee privacy during employment. We discuss background checks, electronic surveillance, the internet and email privacy and more. Employee privacy laws for both U.S. and European union are different in multiple ways. In this document, we will compare the laws by researching the various applicable employee privacy laws both the nations implement for the corporate sector. The two aspects of employee and employer relationship are monitoring employee and conducting background checks. United States European Union The diminished expectation of privacy at the work environment. At the work, environment employees are entitled to expect privacy. Monitoring of employees is okay if the employer is providing a full notice about the monitoring activities and its purpose. Failing to notice will subject the employer to liability Only on instances of important business need and specific instances employee can be monitored by the employer. It is much stricter than the US privacy laws. The privacy laws in use a patch work of the U.S. federal and state privacy laws which regulate the collection of data on certain instances of sensitive information protection of health or financial information, special protection for groups such as children, address the certain abuse of apparent market failure. The collection and use of personal data across all sectors is regulated with omnibus data protection laws. Table 1 United States vs European Union privacy law differences 2.1. United States The primary federal law leading the background checks in united states is the Fair Credit Reporting Act (FCRA). FCRA is applicable to both California and Illinois, the state laws can provide more rights to employees but they will not be able to take away the basics of FCRA. The FCRAs goal is to protect and provide accurate the information regarding the credit history, capacity, reputation and worthiness of the employee/consumer. FCRA is only applicable for the employers or firms and not for individuals who want to perform a background check on themselves or verify their credit reputation. Only particular agencies and employers are eligible for requesting FCRA for the background check. The employer who is requesting the background check must have be complied with certain other Federal and state laws. The employers who request for background check report for employment purpose, per the FCRA the employer or the agencies must provide the employee/ applicant a clear and noticeable printed notice about the change and receive a printed consent from the employer who is requesting the report. The documented printed should be a separate document and not part of another document. Agency who provide the background service for employment, the employer must be certified that the employer: Should have employees consent in printed format Must have provided notice to the employee. The reports information shouldnt be used in violation for equal employment opportunity regulation. Employer must be complied with FCRA requirements, before executing any action with the report In California, the FCRA has a plus, where it allows the applicants who have gone through background check view there report and know if any information is any inaccurate. And it also allows the employer to perform the checks. As FCRA in whole only allows the agency third party to perform the checks. In California, this process is called Investigative Consumer Report (ICR). An employer can only request reports for certain positions and per the categories the applicant must be informed. 2.2. European Union In the European union when the employer wants to run a background check on the applicants or the employees in the firm, to assess and verify the details, the employer must comply to the local member state laws at the firms location and the Data Protection Acts (DP Acts) for EU. Every member state has specific laws which affect the background check, specifically for criminal records. Every member states background check will have a different report. Local state Labor and Employment laws also have obligations on the checks. 2.2.1. France In France for background checks the employer must get prior permissions from the DP Acts in France it is called CINL, this is to collect information for background check. The employer only allowed to get personal information only which is directly relevant to the background checking. The law in France prohibits checks on credit transactions, even if the applicant is willing to provide. Only for certain categories of job position it can be retrieved and must be with consent and information which can be retrieved is limited. The applicants apply for certificate of good standing to get conviction, court record or legal judgements and proceedings. The employer must inform the applicant with the information about: Data transfer to United States People who will receive the information Purpose of the data collection Ability to correct data after its collection Mandatory questions CINL specifies that all the information about the applicant can be viewed and edited after submission of the application for checking. 2.2.2. Germany In Germany Bundesdatenschutzgesetz (BDSG) is the DP Acts that regulates the local law where the applicants personal information cannot be collected and processed without the permission from the applicant, consent is a must and lawfully. Only limited information can be retrieved from the applicant and any violation will lead to fine up to 300,000 pounds. The applicants work development experience and criminal history can be collected and processed. Only during the recruitment process, if failed a written consent will be required from the applicant. Credit worthiness cannot be checked under German DP Acts. 2.2.3. United Kingdom In UK, the information commissioners Office (ICO) regulates the DP Acts. The difference is the ICO states that the data collected must be destroyed in a secureà à manner within six months. 3.1. United States Electronic Communications Privacy Act (ECPA) denies monitoring and tapping of electronic, email, oral and wire communications. Only email accounts given by the employer can be monitored. Stored Communications Act (SCA) is about the stored messages and its access. It is unlawful to access the contents or electronic communication without authorization or intentionally. It also a violation to prevent alter the data in the storage. The SCA states that the employers being the service providers of the email communication service which is dedicated for the firm can be used to monitor the employees email communication and retrieve the email, this has been approved by the US Court. The employers are also reserve the right to monitor the internet usage of the employees in the firm. Employers already mention the policies which will be implied and is requested by the employees to go through them be aware of them being monitored. 3.2. European Union The European unions DP directives and telecommunication directive are considered also European Convention on Human Rights (ECHR) and article 29 working party opinion, all these laws are implied on the monitoring of employees. Monitoring of the employees by the employer is not encouraged until unless there are specific business needs. If the employer decides to monitor an employee then the Working Party asks the employer to follow certain guidelines and be complied, with keeping in mind the employees right to privacy: Transparency Necessity Finality Legitimacy Proportionality Accuracy and data retention Security 3.2.1. Transparency Monitoring is prohibited and is limited in few circumstances, All the policies must be accessible by the employees which specify about monitoring. The employers should clearly mention the actives which will be monitored. The employer should beforehand inform the employees about the monitoring activities. If any misuse is alerted, the employee must be informed about it at the earliest 3.2.2. Necessity Monitoring should be performed only if necessary for exceptional cases. The data related to monitoringà à mustà à be destroyed securely and not retained more than the specified period. Privacy impact assessment must be performed before the monitoring starts. 3.2.3. Finality The data which is collected for monitoring, must be dedicated to the monitoring tasks only and should not be misused by using the data for other process and functions. Proportionality Monitoring of the employee data must be in scope and hidden monitoring actives must be voided by the employer. Having an audio and video monitoring at a place which is expected to ensure privacy must be avoided. 3.2.5. Accuracy and Data Retention The data must be stored only for 3 months and not more. The data collected must be for the mentioned monitoring objectives.à The data collected must be retained and updated for the period of task which required the monitoring. 3.2.6. Security The employer must have in place protection for the personal data logged from monitoring and make sure the data is not being altered or breached. 3.3. France Employee must be informed before monitoring is initiated. The employer must define the policies properly with the mention of disciplinary actions. Before making the policies final the labor inspector must approve the internal rules mentioned in the policy. The related files and emails which are monitored must only be viewed with the concerned employees presence and only during an investigation. 3.4. Germany The employers communication facility must be prohibited to use, until necessary. Then the employee monitoring is approved. In European Union employers, must justify every detail collected about the applicant or employee and the monitoring is nearly denied in law in France, Germany and United Kingdom, these state members impose their own laws. Alternatively, which in United States, the data collection from the employee and applicant is legal under the law until unless it is being misused and deviating from the purpose of the collected personal information. Team members should have a logical approach to problem solving. All problems must be predefined. Also, a deadline for the project is essential. Team members should always give each other a feedback on the progress of their tasks or roles and what have they accomplished. The way that a strategic plan is developed depends on the nature of the organizations leadership, culture of the organization, complexity of the organizations environment, size of the organization, expertise of planners and et cetera. For example, there are a variety of strategic planning models, including goals-based, issues-based, organic, scenario and so on. Goals-based planning is probably the most common and starts with focus on the organiz ations mission, goals to work toward the mission, strategies to achieve the goals, and action planning. Issues-based strategic planning often starts by examining issues facing the organization, strategies to address those issues, and action plans. Organic strategic planning might start by articulating the organizations vision and values and then action plans to achieve the vision while adhering to those values. Planning is one part, though small, of the strategic management process. This can be shown using the roles of corporate managers. One of the four major roles of a manager is to plan. This planning plays a crucial part in determining the success of an organisation as mentioned earlier. But first, we have to ask: What is ââ¬Å"strategic management process?â⬠and ââ¬Å"What are the steps in the processâ⬠. For example, Johnson views it as a six-step process. On the other hand, Viljoen Dann see it as a five-step process. However, in my opinion, I agree most with Robbinsââ¬â¢s view on the process. Robbins et al analyses strategic management process as an eight-step process that consists of strategic planning, implementation and evaluation. Although the first six steps describe the planning that must take place, implementation and evaluation are just as important. Even the finest strategies can fall short if management does not put into practice or assess them properly. The first step in strategic management process is identifying the organisationââ¬â¢s current mission, objective and strategies (Robbins et al 2003). Every organisation requires a statement of the purpose of the organisation, also called a mission. The mission verifies the reason for which the company is in the business. To do this, managers must vigilantly recognize the range of its products and services. It is also vital for managers to identify the goals and strategies currently being pursued in the company. Goals are a foundation of planning which provide the measurable performance targets that the organisation as a whole strives to reach. By being aware of current goals allows managers to decide whether or not these current goals need to be changed. This can also be applied to strategies currently in place. The second step is analysing the environment (Robbins et al 2003). Analysing the environment is a critical step in the strategy process. Robbins describes the external environment as a significant basis on a managerââ¬â¢s actions. To outline a successful strategy, it must be supported well by the environment. In this step, managers need to know what is going on outside the organisation. Information such as what the competitors are doing, what on-going laws might affect the organisation and what degree of labour supply is available around the area where the company is located. Aside from analysing the external environment, managers must also examine specific and general environments to observe and be conscious of the trends and changes which are occurring. This step of the process can be considered complete when the manager has an accurate understanding of what is occurring in the external environment and the developments which could possibly affect the organisation. Following this, managers need to evaluate the results they have achieved in step 2 and determine the opportunities which the company can utilize and threats it encounters. This is all part of the SWOT analysis. Robbins defines opportunities as a positive development in the external environment and threats as negative trends. After identifying threats and opportunities, managers must now look inside the organisation by analysing the organisationââ¬â¢s resources and capabilities (Robbins et al 2003). This includes employeesââ¬â¢ skills, the organisationââ¬â¢s resources, success at innovating products, quality of products, the organisationââ¬â¢s financial status, and the way customers distinguish the organisation. All of these show that no matter how large or how small an organisation is, the organisation is bound to the availability of resources and capabilities. This analysis of the internal environment allows managers to recognize specific capabilities and resources. When these capabilities and resources are outstandingly unique, they can be used as competitive weapons. This key value-generating skill is referred to as core competencies (Robbins et al 2003). From the previous step, the organisation should now have a comprehensible appraisal of its internal resources as well as its capabilities in executing various practical activities. Strengths are any strong capabilities the organisation possesses or unique resource materials (Robbins et al 2003). Weaknesses are the activities which the organisation does not perform well or the lack of resources which they need. Robbins states that different strengths and drawbacks have different outcomes on the strategy being pursued. An organisationââ¬â¢s culture is its personality or characteristics. It is a sign of the organisationââ¬â¢s mutual beliefs and values. When an organisation has a strong culture, it becomes more straight-forward for managers to convey the organisationââ¬â¢s core competencies and strengths to new employees. However, strong cultures are difficult to change. Strategies need to be formulated in all levels of an organisation, be it a corporate, business or functional level. This follows a decision-making process. Strategic alternatives must first be assessed. Managers must select strategies which harmonize with each other and bring out the best of the organisation in terms of its strengths and environmental opportunities. A successful strategy would be one that puts the organisation at a relative advantage over its competitors and the most favourable aggressive edge (Robbins et al 2003). The organisation must try and maintain this advantage to call the strategy a victory. As mentioned earlier, the first six steps are the planning of strategies. After an organisation comes up with strategies, they must apply it. The same efforts put into planning the strategies must be put into implementing it. No matter how effective the strategies are, if the organisation fails to apply it properly, these strategies will be deemed useless (Robbins et al 2003). Implementing strategies efficiently often means that the organisation has to hire new people with different skills, relocating a portion of current employees to new positions, or in the worst case, make redundant some employees. Most organisations nowadays run their management using teams. Therefore, building and managing effective teams is ability in implementing strategies efficiently. Top-management leadership is equally as important. So is a motivated group of middle and lower-managers who perform the organisationââ¬â¢s specific strategy needs. The final step in the strategic management process is evaluating the results of the strategies in terms of effectiveness, and adjustments that need to be made to improve the success of strategies. It is done because it is ââ¬Å"good in itselfâ⬠(Johnson). Both also speak of happiness as ends of being virtuous. However, according to Aristotle, a virtuous life leading to happiness is not achieved without the possession of additional goods as well. A life perceived to be perfect by many, a life with wealth, power, acquaintances, and a physique h ighly appreciated by everyone. With this life also comes good upbringing, and good habits. Without these things, man will have the difficulty of reaching a virtuous status. Aristotle insists that it is necessary to have these desirable things to be able to reach happiness. In a negative light, this is unfair for those who are born without much fortune. If a woman has unacceptable physical features and is not wealthy enough, this theory already forecasts her future or to narrow it, her ability to push for a virtuous life. Another weakness of the theory is the limitation of which it is applicable to. Although it does not claim that only fortunate people are developed to be virtuous, it gives them an advantage to such a life. He points out that if a person who has these things, he will be raised to have good habits and with good habits, he is able to learn how to be virtuous. In reality, unfortunate people also achieve a virtuous life. It is within their strategies in life on how to ge t there. It is not dictated on what a person owns but how people perceive how they life supposed to be and how they would be able to reach that kind of life. Also another argument of Aristotle, because of this kind of upbringing, man will not have any reason for being truthful, openhanded, and brave because it is how one is brought up. Well, unfortunate people can also have this kind of upbringing without material and even physically acceptable attributes. They do well without asking anything in return because of their misfortune but they do well because they feel that it is the right thing to do and doing such will lead them to some state of happiness. In all fairness to Aristotle, he provides an ideal state of virtuous life that one ought to pursue. Kant, on the other hand, does not provide a status for which virtue can be obtained. He does not give material possession and physical attributes importance when it comes to being a moral person. He said that virtue does not insure wel l being (Johnson). Kant proposes that man should be rational with his actions based on the standards of rationality. There should be universality in a sense that manââ¬â¢s actions should be widely accepted by others as well. Kantââ¬â¢s theory suggests that in order for man to achieve a morality that is powerful enough to compel one from doing injustice to another or to himself, man will undergo challenges in a sense that one can learn what is good and what is bad.
